Procedure for collection of Service Charges
Service Charges are due on 1st April and 1st October each year. On 15th of the month prior to this due date an invoice is issued for the Service Charge amount, giving you an early reminder of the due date of the 1st of the month.
Owners are requested to pay their service charge promptly on the due date, or shortly thereafter. Owners are further requested to pay the monies they owe by electronic transfer using the bank details supplied on the invoice. If you continue to pay by cheque, we will record the "payment date" as the date of receipt of the cheque, not the date that we bank it, unless you send a cheque prior to the due date in which case the due date of the 1st of the month will be logged as the "payment date".
Recording the correct payment date is important as we keep history records showing when owners paid their service charges. These records may be used in the event of any dispute between the management company and an owner over late payment of service charges any other matters relating to them. We believe the records to be accurate but if an owner considers there to be any error in our records it is incumbent on them to bring the matter to the attention of the management company.
Late payment of Service Charge
On the 15th of the month after the due date for payment of the Service Charge, we will issue a standard letter “firmly and formally” making three points:
- that there remain a further seven days within which a payment is demanded or court proceedings will be initiated,
- that the moment court proceedings have been initiated, court costs will have been incurred, making the defaulting owner liable for these in addition to the Service Charge,
- that no further reminder will be issued and that this process will happen automatically if the Service Charge is not received within this additional seven days of grace.
